Terms of Service

Welcome to PupTrace. These Terms of Service ("Terms") govern your access to and use of puptrace.com (the "Site") and any orders you place with us (collectively, the "Services"). PupTrace is operated by Social Data Media Limited, a company registered in Hong Kong SAR. All references to "PupTrace", "we", "us", and "our" in these Terms refer to Social Data Media Limited.

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy and Refund & Returns Policy, which are incorporated by reference. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent that the information you provide is accurate and that you have the legal capacity to enter into a binding contract.

2. Accounts

You may place orders as a guest or create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@puptrace.com if you suspect unauthorized use.

3. Products, pricing, and availability

We make reasonable efforts to display products, prices, and inventory accurately, but we do not warrant that descriptions, images, pricing, or availability are error-free. Prices are listed in the currency shown at checkout and exclude any taxes, duties, or shipping unless stated.

We reserve the right, at any time and without prior notice, to: (i) modify or discontinue any product; (ii) limit order quantities; and (iii) refuse or cancel any order — for example, where we reasonably believe an order is fraudulent, where pricing or product information was displayed in error, or where production or supply is unavailable. If we cancel an order after payment, we will issue a full refund to the original payment method.

4. Orders, payment, and order confirmation

When you place an order, you make an offer to purchase. Your order is accepted only when we send you an order confirmation by email (with an order number beginning with PT-). Receipt of a payment-authorization email from Stripe, PayPal, or your card issuer does not constitute order acceptance.

Payments are processed by Stripe (card payments) and PayPal (wallet payments). We do not receive or store full payment card numbers. By placing an order, you authorize the relevant payment processor to charge the amount due to your selected payment method.

5. Made-to-order and personalized pieces

Most PupTrace pieces are made to order. Each piece is hand-drawn and laser-engraved for one buyer based on the photograph, name, engraving text, or other specification you provide at checkout (a "Customer Specification").

  1. Specification lock window. Once an order enters production, the Customer Specification is locked. You may request changes only within 6 hours of placing the order by emailing support@puptrace.com. After that window, the design is in progress and the specification cannot be modified.
  2. Production-time estimates. We publish typical production and shipping timeframes on the Site and in our Shipping Policy. These are estimates, not guarantees. Delays caused by carriers, customs, weather, or force majeure events are not the responsibility of PupTrace.
  3. Approval of design previews. Where we send you a sketch, mockup, or design preview for approval, you are responsible for reviewing it carefully (spelling, layout, likeness, color). Production proceeds based on your approval; we are not liable for errors in approved specifications.
  4. Returns. Personalized pieces are non-returnable except where the piece arrives damaged, defective, or substantially different from the design we approved with you. See our Refund & Returns Policy for full details.

6. Your content — photos, names, and other Customer Specifications

When you submit a photograph, name, engraving text, or other Customer Specification ("Customer Content") for an order or for a free design preview, the following terms apply:

  1. Your rights and warranties. You represent and warrant that (i) you own the Customer Content or have all necessary rights, licenses, and permissions to submit it for the purposes described in these Terms; (ii) the Customer Content does not infringe the intellectual-property, privacy, publicity, or other rights of any third party; and (iii) any depicted person has consented to the use described here (for example, a co-owner of the photograph).
  2. License you grant to PupTrace. You grant PupTrace a non-exclusive, royalty-free, worldwide license to host, store, reproduce, modify, and adapt the Customer Content solely for the purpose of producing your order or design preview, providing customer support, and maintaining order records as required by law. We do not sell or sublicense your Customer Content. Photograph retention is described in our Privacy Policy (typically 30 days after delivery, after which the photograph is automatically anonymized or deleted).
  3. Marketing use is opt-in only. We will not publicly publish, post on social media, or use Customer Content in advertising or marketing without your separate, explicit consent.
  4. Removal. You may request that we delete a photograph at any time by emailing support@puptrace.com, subject to our need to retain order records as required by law.
  5. Prohibited content. You must not submit Customer Content that is unlawful, defamatory, obscene, infringing, contains another person's image without consent, or that we reasonably determine is inappropriate. We reserve the right to refuse production where Customer Content violates this clause and to issue a full refund.

7. Intellectual property

  1. PupTrace IP. The Site, the PupTrace name and logo, our product designs (including the underlying jewelry forms, settings, and templates), our artist-drawn sketches and renderings, our photography, copy, and other materials we create are the intellectual property of PupTrace or our licensors and are protected by copyright, trademark, and other laws. Except as set out below, no rights are granted to you by implication.
  2. Finished piece — your license. When you purchase a finished piece, you own the physical object. You receive a personal, non-exclusive, non-transferable license to display, wear, and gift the piece for personal use. You may not (i) reproduce the piece commercially; (ii) sell reproductions of the artist-drawn sketch as a separable artwork; or (iii) use the PupTrace brand or design templates to manufacture competing products.
  3. Artist sketches. Hand-drawn sketches produced as part of your order, or as a free design preview, are the copyrighted work of PupTrace and its artists. Posting a sketch on social media or messaging apps for personal sharing is permitted and welcomed. Selling, sublicensing, or using a sketch commercially, or using a sketch to commission a competing product from another manufacturer, is prohibited without our written permission.
  4. Feedback. If you send us suggestions, ideas, or feedback, you grant us a perpetual, royalty-free license to use that feedback without obligation to you.

8. Communications

Our primary customer-service channel is email at support@puptrace.com. By placing an order you authorize us to send you transactional email at the address you provide (order confirmations, shipping updates, return correspondence, design previews for approval). Marketing email is opt-in only and you may unsubscribe at any time using the link in any marketing email. Failure to monitor the email address used for an order may delay design-preview approval, return processing, or other order-related communication; we are not responsible for delays caused by undelivered or unmonitored email.

9. Allergy and skin reactions

Our pieces are jewelry and keepsakes, not medical or therapeutic devices. We use 316L surgical-grade stainless steel as our base metal, which is rated for sensitive skin, but individual reactions can occur. We make no medical claims and recommend you discontinue wear and consult a medical professional if you experience an adverse skin reaction. Refunds in cases of allergic reaction are handled under our Refund & Returns Policy and our published FAQ.

10. Acceptable use of the Site

You agree not to: (i) use the Services for any unlawful purpose; (ii) attempt to gain unauthorized access to the Site, our systems, or other users' accounts; (iii) scrape, copy, or commercially exploit Site content without our consent; (iv) interfere with the Site's operation (for example, by submitting malware or excessive automated traffic); or (v) use the Services to harass, defame, or harm any person.

The Site uses third-party services (including Shopify, Stripe, PayPal, Klaviyo, Google, Meta, and TikTok) and may link to third-party sites. We are not responsible for the content, policies, or practices of those third parties. Use of those services and sites is governed by their own terms and privacy policies.

12. Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, PupTrace disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or that defects will be corrected. Statutory consumer rights that cannot lawfully be excluded are not affected by this clause.

13. Limitation of liability

To the maximum extent permitted by law, PupTrace's aggregate liability arising out of or in connection with your use of the Services or any order is limited to the greater of (i) the amount you paid for the order giving rise to the claim, or (ii) USD 100. PupTrace will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or sentimental value, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

14. Indemnification

You agree to indemnify and hold harmless PupTrace, its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from (i) your breach of these Terms; (ii) your Customer Content (including any third-party rights claim); or (iii) your unlawful use of the Services.

15. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, government action, carrier disruption, customs delays, supply-chain failures, or industrial action.

16. Governing law and dispute resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or any order shall be resolved in the courts of Hong Kong SAR, except that consumers resident in the European Union, the United Kingdom, or another jurisdiction with mandatory local consumer-protection law may bring proceedings in their place of residence as required by that local law.

Before commencing formal proceedings, both parties agree to attempt in good faith to resolve any dispute by writing to support@puptrace.com with a clear description of the issue. We will respond within 14 days.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Where required by law, we will give you advance notice. Your continued use of the Services after the effective date of any change constitutes your acceptance of the revised Terms.

18. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force. These Terms, together with the documents incorporated by reference (Privacy Policy, Refund & Returns Policy, Shipping Policy), constitute the entire agreement between you and PupTrace regarding the Services and supersede any prior agreements.
